Momentum Membership Terms & Conditions

Introduction:
In this document, “I” refers to Pankita Panchal, your Coach, who will be personally delivering all sessions. I am a Master NLP Coach, a 2x Award Winner for Best Life Coach, and a Time Line Therapy Service Provider. I have earned the Top Life Coaching Badge on LinkedIn and proudly hold a zero-failure record so far. Your investment in this program is an investment in proven success and dedicated support.

1. Program Scope & Expectations
The Momentum Membership is distinct from my exclusive 7-Step Signature Program and Time Line Therapy program. This membership does not include Time Line Therapy sessions or specialized NLP techniques like part integration. These services are available only through separate programs, which must be purchased independently. While I guarantee results in my specialized programs, the Momentum Membership does not come with a results guarantee. I will apply appropriate techniques at the right time, but such techniques may not be utilized every month. The membership is designed for consistent support, not intensive transformation.

2. Minimum Commitment & No Refunds
The Momentum Membership requires a minimum commitment of 3 months. This is to ensure that clients have ample time to engage with the program and see meaningful progress. Early cancellation before the 3-month period will still require full payment for the remaining months of the commitment period. All payments for the Momentum Membership are final. There are no refunds, returns, or exchanges for any payments made. By enrolling in this program, you acknowledge and agree that no refunds will be provided under any circumstances.

3. Professional Liability & Disclaimers
While I carry professional indemnity insurance for UK clients, it is important to note that I am not a licensed medical or psychological professional. The services provided through the Momentum Membership should not replace professional medical, psychological, or legal advice. All decisions and actions you take as a result of this coaching are entirely your responsibility. Under no circumstances can I be held responsible for any direct or indirect consequences, damages, or losses arising from your participation in this program during or after the program, now or in the future. You cannot harm me by any means—personally, professionally, or emotionally—now or in the future. My purpose is to support your journey, not to involve unnecessary conflicts or disputes. I do not encourage or advise you to discontinue any medical treatments to join this program. This membership is an additional support path, not a replacement or substitute for any medical treatment, psychological care, or business planning and risk management.

4. Session Delivery
All coaching sessions will be conducted via Zoom, regardless of whether you are a UK-based or international client. Under no circumstances will in-person meetings be arranged.

5. Client Responsibilities

  • Session Scheduling: Scheduling your coaching sessions is entirely your responsibility. No reminders will be sent under any circumstances. It is crucial that you prioritize your scheduled calls by setting multiple reminders or using a calendar to ensure you are on time. Please note that late arrivals will result in a reduction of session time, and it is not my responsibility to compensate for any lost time.
  • Prohibited Actions: You are prohibited from sharing your login details, reselling, or redistributing the content provided through the Momentum Membership. Engaging in these prohibited actions will result in immediate termination of membership without a refund.

6. Payment Methods & Late Fees

  • UK Clients: Payment must be made via BACS (Bankers’ Automated Clearing Services). Please discuss payment details directly with me.
  • International Clients: All payments will be processed through Stripe.

If a payment fails, Stripe will automatically retry the payment. If the payment is not successfully processed within 5 days of the due date, a late fee of 5% of the monthly membership fee may be applied. You will be notified of any failed payments and given a brief grace period to update your payment information. If payment remains outstanding after 15 days, the membership will be automatically canceled, and you will still be responsible for paying any outstanding balance.

7. Service Cancellation by Coach
I reserve the right to cancel coaching services at any time if you display disrespect, use inappropriate language, or exhibit threatening behavior during sessions or in written communications. If this occurs, cancellation will be effective immediately, and you will remain liable for the remaining billing cycle. No further sessions will be offered after cancellation.

8. Access to Content and Intellectual Property

  • Content Ownership: All content provided through the Momentum Membership is owned by me. You are granted a non-exclusive, non-transferable license to use the content for personal use only.
  • Content Usage: You may not redistribute, copy, or use the content for commercial purposes. Violation of this policy will result in immediate termination of membership and access to the content, with potential legal action.
  • Termination of Access: Access to membership content may be terminated if the terms of this agreement are violated, including prohibited actions like reselling or sharing login details.

9. Confidentiality & Recordings
All information shared during coaching sessions and through the Momentum Membership is strictly confidential. No recordings of the sessions will be provided to clients. However, some sessions may be recorded by me for quality assurance purposes. These recordings will not be used in any other way. I am committed to respecting your privacy and confidentiality.

10. Disclaimer of Liability
I am not liable for any direct or indirect damages, losses, or injuries that may result from the use of the membership content or services, during or after the program, now or in the future. By participating in this program, you acknowledge that you are solely responsible for your actions and decisions.

11. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Bedfordshire, United Kingdom. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Bedfordshire, United Kingdom.

12. Changes to Terms & Conditions
I reserve the right to modify these Terms & Conditions at any time. Members will be notified of any significant changes via email at least 30 days before the new terms take effect.
